1. PURPOSE AND SCOPE

These General Terms and Conditions govern the use of the online store operated by Florentino Colección S.L., with registered office at Polígono Industrial Lalín 2000, Calle B 30-34, 36500 Lalín (Pontevedra), Spain, VAT number ESB36057933, registered in the Mercantile Registry of Pontevedra, Folio 197, Book 668, first entry, sheet 9486 (hereinafter “Florentino”, “the Company” or “we”).

Accessing, browsing and using this online store (the “Platform”) implies the express and unconditional acceptance of these Terms and Conditions.


2. DATA CONTROLLER

Florentino Colección S.L. is the data controller for the personal data provided by users through the Platform, in accordance with our Privacy Policy.


3. ACCEPTANCE OF TERMS

By using this Platform, the user declares that they are of legal age and have the legal capacity to enter into contracts. The user undertakes to:

  • Provide truthful and complete information.

  • Not place fraudulent orders or use unauthorised payment methods.

  • Comply with applicable laws and use the Platform appropriately.

Placing an order implies the user’s acceptance of these Terms.


4. FORMATION OF THE CONTRACT

The sales contract between the user and Florentino is deemed concluded when the user receives an order confirmation email.

We reserve the right to reject orders for justified reasons, such as errors in price or stock availability.


5. TERRITORIAL SCOPE

Sales through this Platform are available only to Spain (excluding the Canary Islands, Ceuta and Melilla) and to European Union countries where purchase is enabled via the country selector.

We do not ship to territories with special tax regimes or customs duties (e.g., Canary Islands, Ceuta, Melilla, Madeira, Azores, etc.).


6. PRICES, VAT AND SHIPPING COSTS

Prices displayed on the Platform include VAT applicable in Spain, unless otherwise stated.

Shipping costs will be indicated during the checkout process before order confirmation.

The user is responsible for any additional taxes or charges applicable in their country, if any.


7. PAYMENT METHODS

Payments are made through the methods available on the Platform. Payment data is securely processed by third-party payment providers (e.g., Stripe, PayPal, or others), and Florentino does not store full credit/debit card details.

The user guarantees that they are the authorised holder of the chosen payment method.


8. PRODUCT AVAILABILITY

Products are offered while stocks last. In case of unavailability, Florentino will inform the user and may offer alternatives or refund the amount paid.


9. DELIVERY

Delivery times are indicated in the order confirmation. Delays not attributable to Florentino (e.g., force majeure or carrier issues) shall not be the responsibility of the Company.


10. IT SECURITY AND PROPER USE

The user agrees not to introduce viruses, malware or any harmful code into the Platform, nor to perform actions that may affect its operation or security.

Any improper use may be reported and legally pursued.


11. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the Platform (trademarks, logos, texts, photographs, designs, code, etc.) is the property of Florentino or third parties who have authorised its use.

The user may not reproduce, distribute, modify or use such content without prior written consent.


12. LINKS TO THIRD-PARTY WEBSITES

The Platform may contain links to third-party websites. Florentino does not control and is not responsible for the content, services or privacy policies of such sites.


13. ELECTRONIC COMMUNICATIONS AND MARKETING

The user accepts receiving communications related to their orders by email.

Commercial communications and marketing (email and SMS) require prior and explicit consent, in accordance with our Privacy Policy.

15. MODIFICATION OF TERMS

Florentino reserves the right to modify these Terms at any time. The Terms applicable will be those in force at the time of placing the order.


16. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law.
For any dispute, the parties submit to the courts and tribunals of the consumer’s domicile, when permitted by law, or to those of Pontevedra (Spain).
